Gite Owners - any experience w evicting long term tenants?

Hi! I'd be grateful to hear about some tips/issues related to evictions. My tenants are in breach of contract for not paying all of their rent. The contract is a basic short term furnished English contract........

I know nothing about this at all except that, if you're going to do it, you need to get on with it as I believe that in France there is a certain time of year (deepest winter, I think) when you are not allowed to evict tenants even if they are in breach of their contract.

I would think the best thing you can do is contact a solicitor pdq, to be honest.

Thanks for your quick reply. Yes, I'm hoping the ban on evicting in the winter does not apply to short term furnished leases. Best to act quick! does anyone know a local english speaking solicitor (as opposed to a notaire)

Effectively, you have no contract ?

I agree with Peter. An English contract cannot be enforced in France.

Hi Marierose,

I'm sorry to say but Peter & Blackduff are correct,your English contract carries no weight here, the legistlation regarding the rental of property,long or short term are totally different to the UK.
I'd seek some legal advice in France first ...

Just for the record...
- Are your tenants British Citizens or other NON-French (EU?) or French nationality?
- Are they officially registered in France as permanent residents and if not what is THEIR status as to French residency?
(Very topical subject, these days!!!)

Could perhaps make a difference to the way the law would treat your case??

The tenants are non-french. One is a UK citizen and one is non-EU.

I'm not sure if they are officially registered as permanent residents in France. I have reason to believe that they are not.

Do you know how I could check their residency status?

1st November - 15th March are the Winter dates when one can not be evicted from a property. They probably know the dates if they are that 'sort'. You have some time yet. Monsans

What does your contract say about giving them notice? I would try and issue notice according to what was agreed at the outset. You could also try Graham Platt of Heslop and Platt Engish solicitor French avocat based in UK on 44 0113931930 0r www.heslop-platt.co.uk.

I too use an English contract for short term lets but a French contract for Long term. I don't think the eviction issue is an issue with a shorterm let but the Avocat will advise.

i had the same problem this summer, a couple rent my studio in may and spend all the summer inside without paying any euro. They left the property after i disconnected the electricity. You can do it on line.
